The NSW Commission for Children and Young People Act 1998 establishes a Working with Children Background Check that enables employers to submit the names of preferred applicants for child related employment to help inform recruitment decisions. Decisions about whether a position at OCTEC constitutes 'child related employment', and would therefore require a Working with Children Background Check, are made on a case by case basis by senior management. As a guide, positions delivering employment outreach services, youth services, or training and assessment services in a venue other than Old Town Hall Building, will generally require a Working with Children Check. Positions delivering training and/or assessment services in aged care facilities will generally require an Australian Federal Police Criminal Record Check, in accordance with requirements relating to certain staff members and volunteers of approved aged care providers established under the Aged Care Act 1997.
